These Terms of Use ("Terms") govern your access to and use of DryScout websites, applications, AI-assisted communications, digital intake experiences, and related services made available by RunMyData LLC, doing business as DryScout ("DryScout," "we," "us," or "our").
By accessing or using DryScout, you agree to these Terms.
If you use DryScout on behalf of a company, property owner, property management organization, or other entity, you represent that you have authority to act on its behalf.
If you or your organization has entered into a separate written agreement with RunMyData LLC concerning DryScout, that agreement controls to the extent it conflicts with these Terms.
1. About DryScout
DryScout provides technology designed to help property management and real estate organizations receive, understand, structure, manage, and act on property-related information.
Depending on the service, DryScout may support:
- AI-assisted telephone intake
- Digital intake
- Staff-assisted intake
- Transcription and summarization
- Categorization and prioritization
- Identification of potential urgency
- Assignment and workflow
- Operational visibility
- Organization and location information supporting intake operations
Features may vary by customer or configuration and may change as DryScout evolves.
2. DryScout Is a Technology Provider
DryScout provides technology and workflow capabilities.
DryScout is not, merely because you access or use the service:
- A landlord or property manager
- A property owner
- A maintenance or repair company
- A restoration company
- A contractor or trade professional
- An emergency response service
- A security service
- An insurance company or insurance advisor
- A legal, medical, engineering, construction, or other professional-services provider
Using DryScout does not create any such relationship.
Property owners, property managers, customer organizations, contractors, vendors, and other responsible parties remain responsible for their own decisions, obligations, communications, services, repairs, responses, and operations.
3. Property Requests and Communications
DryScout may be used to submit or process information concerning maintenance, repairs, access, property conditions, leasing, resident concerns, vendor matters, scheduling, account questions, and other property-related needs.
Submitting information through DryScout does not guarantee that:
- A property owner or property manager has reviewed the information
- A particular person has accepted responsibility for the request
- A request will be approved
- A contractor or vendor will be dispatched
- A particular response time will be met
- A requested repair, accommodation, service, or action will be provided
- A particular outcome will occur
The organization responsible for the property determines the appropriate operational response.
DryScout may help receive, communicate, structure, or advance information. It does not independently assume responsibility for resolving the underlying property matter.
4. Emergencies and Life-Safety Situations
DryScout is not an emergency service.
Do not rely on DryScout, an AI assistant, a digital form, or a property-management workflow when there is an immediate threat to life or safety.
If you are experiencing an emergency, including a fire, medical emergency, suspected gas leak, active crime, or other immediate life-safety situation, call 911 or the appropriate local emergency service.
Submitting information through DryScout is not a substitute for contacting emergency responders.
An urgency classification or similar output generated through DryScout should not be treated as a guarantee that a situation has been correctly assessed.
5. Artificial Intelligence and Automated Processing
DryScout uses artificial intelligence and other automated technologies.
These technologies may assist with functions such as:
- Understanding communications
- Transcription
- Summarization
- Structuring information
- Categorizing requests
- Identifying potential urgency
- Prioritizing information
- Routing information
- Supporting operational workflows
Artificial intelligence is not infallible.
AI-generated transcripts, summaries, classifications, categorizations, urgency assessments, recommendations, or other outputs may be incomplete, inaccurate, delayed, or misunderstood.
Users and customer organizations remain responsible for exercising appropriate human judgment and reviewing information when circumstances warrant it.
DryScout does not guarantee the accuracy or completeness of AI-generated output.
6. Telephone and Voice Services
Some DryScout services use AI-assisted telephone systems.
Telephone interactions handled through DryScout voice services are generally recorded and may be transcribed, summarized, analyzed, or otherwise processed.
Our handling of personal information associated with these communications is described in our Privacy Policy.
Customer organizations using DryScout communications functionality remain responsible for their own use of the service and for compliance with laws applicable to their operations.
7. Accuracy of Information
Please provide information that is reasonably accurate and complete to the best of your knowledge.
You should not knowingly provide false, misleading, fraudulent, or malicious information.
DryScout may process, summarize, categorize, or restructure information provided by callers, users, customers, or other parties, but we do not independently verify every statement submitted through the service.
If you become aware of a material error in information you provided, you should provide corrected information where reasonably possible.
8. Customer and Authorized User Responsibilities
Organizations using DryScout remain responsible for their own operations.
Customers and authorized users are responsible for matters within their control, including:
- Reviewing property-related information when appropriate
- Determining the appropriate response to requests
- Managing access to their DryScout environment
- Maintaining appropriate user permissions
- Keeping login credentials confidential and protecting access to their accounts
- Making property-management and business decisions
- Managing employees, vendors, contractors, and service providers
- Complying with laws applicable to their operations
- Maintaining accurate information under their control
DryScout does not assume these responsibilities merely because information is processed through the platform.
9. Permitted Use
You may use DryScout only for lawful purposes and in accordance with these Terms.
You may not:
- Use DryScout in violation of applicable law
- Submit knowingly false or fraudulent information
- Impersonate another person or misrepresent your authority
- Harass, threaten, abuse, or unlawfully discriminate against another person
- Attempt to gain unauthorized access to accounts, systems, or information
- Circumvent authentication, security, access, or usage controls
- Interfere with the operation or security of DryScout
- Introduce malware, malicious code, or harmful material
- Probe or test systems without authorization
- Scrape or systematically extract information except as permitted by law or written authorization
- Reverse engineer or attempt to derive protected source code except where such restrictions are prohibited by law
- Use DryScout to facilitate illegal activity
- Knowingly misrepresent a situation as an emergency or knowingly submit false urgency information
- Use the service in a manner that could reasonably damage DryScout, its customers, users, or infrastructure
We may restrict or suspend access when reasonably necessary to protect DryScout, our customers, users, or others.
10. Information and Content You Provide
You retain whatever ownership rights you otherwise have in information or content you submit to DryScout.
You grant DryScout the rights reasonably necessary to receive, host, process, transmit, organize, display, and otherwise use that information to:
- Provide the requested service
- Support the applicable customer workflow
- Operate and secure DryScout
- Comply with legal obligations
- Perform activities otherwise described in our Privacy Policy or an applicable customer agreement
You represent that you have the right to provide information you submit when authorization is required.
This section does not transfer ownership of your personal information or confidential business information to DryScout.
11. Privacy
Our Privacy Policy explains how DryScout collects, uses, discloses, and otherwise processes personal information.
When DryScout processes information associated with a property-management customer, that organization may independently determine how information is used within its operations.
12. Intellectual Property
DryScout and its software, websites, interfaces, designs, branding, logos, documentation, workflow designs and templates, text, graphics, and other proprietary materials are owned by RunMyData LLC or its licensors and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms or a separate written agreement, you may not:
- Copy or reproduce DryScout proprietary materials
- Sell, sublicense, or distribute them
- Create unauthorized derivative works
- Remove proprietary notices
- Use DryScout branding in a manner suggesting endorsement or affiliation without authorization
Subject to these Terms and any applicable customer agreement, authorized users receive a limited, non-exclusive, non-transferable, revocable right to access and use DryScout for its intended purpose.
No ownership interest in DryScout is transferred to you.
13. Feedback
If you voluntarily provide ideas, suggestions, or feedback concerning DryScout, you authorize us to use that feedback to develop, improve, or operate our products and services without compensation or obligation to you.
This does not give DryScout ownership of your personal information or confidential information merely because it is included in a communication.
14. Third-Party Services
DryScout relies on third-party technologies and service providers to support portions of the service.
We do not control every aspect of third-party systems.
Availability or functionality may occasionally be affected by telecommunications providers, infrastructure providers, cloud services, internet connectivity, or other systems outside our reasonable control.
Your use of certain third-party services may also be subject to the third party's own terms and policies.
15. Service Availability and Changes
DryScout is an evolving technology platform.
We may add, modify, replace, test, suspend, or discontinue features or portions of the service.
We do not guarantee that DryScout will always be available, uninterrupted, error-free, compatible with every device or system, or maintain every existing feature indefinitely.
Scheduled maintenance, technical failures, internet or telecommunications problems, third-party outages, security events, or circumstances outside our reasonable control may affect availability or operation.
16. No Guaranteed Business or Operational Outcome
DryScout is intended to help organizations improve how property-related information is received, structured, understood, and advanced through operations.
Technology cannot eliminate every human error, operational delay, property loss, or service issue.
DryScout does not guarantee that use of the service will:
- Prevent property damage
- Eliminate human error
- Produce a particular financial or operational result
- Ensure resident, tenant, customer, or property-owner satisfaction
Results depend on factors outside DryScout's control, including customer procedures, staffing, configuration, decision-making, physical property conditions, third-party providers, and information supplied by users.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRYSCOUT AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
RUNMYDATA LLC DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND OTHER WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THE MATTERS DESCRIBED IN SECTIONS 15 AND 16 OR THAT AI-GENERATED INFORMATION WILL ALWAYS BE ACCURATE OR COMPLETE.
NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RUNMYDATA LLC, DRYSCOUT, AND THEIR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL, OR DATA ARISING FROM OR RELATING TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF RUNMYDATA LLC ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF:
(A) THE AMOUNTS PAID DIRECTLY BY YOU TO RUNMYDATA LLC FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
(B) $100 IF YOU PAID NO AMOUNTS DIRECTLY TO RUNMYDATA LLC FOR THOSE SERVICES.
THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW AND DO NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
19. Indemnification by Business Users
If you use DryScout on behalf of a business or organization, then, to the extent permitted by applicable law, that organization agrees to defend, indemnify, and hold harmless RunMyData LLC and its officers, employees, and affiliates from third-party claims, liabilities, damages, losses, and reasonable costs arising from:
- The organization's unlawful use of DryScout
- Information or materials submitted by the organization in violation of law or third-party rights
- The organization's material violation of these Terms
- Property-management, leasing, maintenance, vendor, employment, or other operational decisions made by the organization and outside DryScout's role as a technology provider
This obligation does not apply to the extent a claim results from conduct by RunMyData LLC for which indemnification cannot lawfully be required.
This section applies to business and organizational users. It does not impose a commercial indemnification obligation on a resident or other individual merely because that person submits a property-related request.
20. Suspension and Termination
We may suspend or terminate access to DryScout when reasonably necessary because of:
- A material violation of these Terms
- Unlawful or fraudulent activity
- Security concerns
- Risk of harm to DryScout, a customer, user, or third party
- Nonpayment under an applicable customer agreement
- Discontinuation of the applicable service
Organizations operating under a separate written agreement may have additional rights and obligations concerning suspension and termination.
Provisions that by their nature should survive termination will remain in effect after access ends.
21. Governing Law and Venue
Except where applicable law requires otherwise, these Terms and disputes arising from them are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.
Subject to applicable law and any separate written agreement, disputes arising from these Terms will be brought in a state or federal court of competent jurisdiction located in or serving Orange County, Florida.
Nothing in this section eliminates rights or remedies that cannot lawfully be waived.
22. Changes to These Terms
We may update these Terms as DryScout and our services evolve.
When we update the Terms, we will revise the effective date at the top of this page.
Where appropriate or required by law, we may provide additional notice of material changes.
Your continued use of DryScout after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
23. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
24. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
25. Entire Agreement
For users who do not have a separate written agreement with RunMyData LLC, these Terms and any additional terms presented for a particular service constitute the agreement governing use of the applicable DryScout services.
Our Privacy Policy separately describes our processing of personal information.
If you or your organization has a separate written agreement with RunMyData LLC, that agreement controls to the extent of any conflict.
